General Terms and Conditions


This is a courtesy translation of our German Allgemeine Geschäftsbedingungen. The German version is legally binding.

§ 1 Scope

For all business relationships between MOCFOR and the customer, our General Terms and Conditions in the version valid at the time of the order apply exclusively.

§ 2 Conclusion of contract

Our online offerings are not binding offers to enter into a purchase contract, but merely an invitation to you to submit an offer. By clicking the "Order" button, you submit a binding order for the goods in the shopping cart. After completing your order, you will receive an immediate e-mail from us that merely confirms the receipt of your order and does not yet constitute acceptance of your offer to purchase. A purchase contract through our acceptance of your offer is concluded only when we accept your order by sending an order confirmation in a further e-mail or have shipped the ordered goods to you and have confirmed the dispatch of the goods to you in a further e-mail, which will, if applicable, take place no later than 112 days after we received your order.

§ 3 Delivery

If it is not possible for us to deliver the ordered goods to you in a single shipment — for example because the items must be packaged separately or are partly available only at a later date — no additional costs will be incurred by you. We reserve the right to make such partial deliveries.

As a rule, the goods are transported only as far as the first door of the customer's delivery address. Transport within the building must be carried out by the customer. If on-site transport within the building of the ordered goods is necessary, this special service will, by prior arrangement, be charged to you cost-effectively according to actual effort. Please indicate any such additional transport requests as early as the order.

Goods are delivered by shipment to the delivery address provided by the customer, unless otherwise agreed. The delivery address stored by the customer is decisive for the processing of the transaction. As an exception, when paying by PayPal, the delivery address stored at PayPal at the time of payment is decisive.

If the carrier returns the shipped goods to the seller because delivery to the customer was not possible, the customer bears the costs of the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstance that led to the impossibility of delivery, or if the customer was temporarily prevented from accepting the offered service — unless the seller had given the customer reasonable advance notice of the service.

§ 4 Prices & payment options 

The prices published by us at the time of your order apply. Prices are stated in euros and include the applicable statutory VAT plus individual shipping costs. If the customer is in default of payment, the statutory default rules of § 288 BGB apply.

Payments are generally to be made by advance payment within 10 days of the request for payment. If you make payment at a later time, you may not be able to assume that we still have the goods you ordered in stock and can deliver them to you afterwards. You can pay by advance bank transfer, PayPal, Sofortüberweisung or by invoice.

For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which are to be borne by the customer. These include, for example, costs for money transmission by credit institutions (e.g. transfer fees, exchange-rate fees) or import duties or taxes (e.g. customs duties).

§ 5 Shipping cost share

Please refer to the offer for the respective shipping costs.

For self-pickup, the seller first informs the customer by e-mail that the ordered goods are ready for pickup. After receiving this e-mail, the customer can pick up the goods at the seller's premises by arrangement with the seller. In this case, no shipping costs will be charged.

§ 6 Retention of title, set-off

The delivered goods remain the property of MOCFOR until full payment has been made. If the customer has resold the goods before full payment, the customer's claims against the third-party purchaser shall be deemed assigned to MOCFOR.

§ 7 Warranty

Statutory warranty rights apply. If the goods delivered to you exhibit obvious material or manufacturing defects or transport damage, please notify us or the carrier delivering the ordered goods immediately. Failure to give such notice has no consequences for your statutory rights.

§ 8 Place of jurisdiction for contracts with merchants

If the customer is a merchant or has their domicile outside Germany, the exclusive place of jurisdiction is Flensburg. German law applies exclusively to such contracts with merchants.
